Luigi Mangione avoids death penalty in UnitedHealthcare CEO murder case

A federal judge in Manhattan has dismissed the federal murder charge against Luigi Mangione in the killing of UnitedHealthcare CEO Brian Thompson. This ruling removes the possibility that Mangione could face the death penalty in this case.

The decision came down on a Friday from US District Judge Margaret Garnett. She explained that Supreme Court rulings mean the federal murder charge must be dropped because it conflicts legally with two federal stalking charges that are still pending against Mangione.

Despite this setback for prosecutors, Mangione could still be sentenced to life in prison if found guilty of the remaining federal charges. He is also facing nine charges brought by New York state prosecutors, including second-degree murder and weapons offenses. Mangione has pleaded not guilty to all allegations.

The legal debate centered on the definition of "violence" required for the death penalty to apply. Prosecutors had to prove that Mangione committed murder while committing another crime of violence. However, Judge Garnett ruled that stalking does not meet that definition based on case law. She acknowledged the outcome seemed odd, as few would argue the actions were not violent, but said the court was bound to follow Supreme Court precedents.

Authorities say Mangione targeted Thompson after crossing state lines. They described the killing as planned and symbolic, motivated at least in part by anger toward the health insurance industry and the broader US healthcare system.

Mangione, 27, has been in custody since his arrest and pleaded not guilty to all federal charges related to Thompson’s death in December 2024. Jury selection for the federal case was set to start in September.
